1. Introduction and Acceptance of Terms

Welcome to Hyvote ("we," "us," "our"), a Hytale server listing platform operated by Lucid ICT Limited, a company registered in Scotland (Company Number: SC760973) with its registered address at Suite 2/3, 48 West George Street, Glasgow, Scotland, G2 1BP.

These Terms of Service ("Terms") govern your access to and use of the Hyvote website located at https://hyvote.org (the "Site") and all related services, features, and content (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Definitions

"User" refers to any individual who accesses or uses the Service, including server owners, voters, and general visitors.

"Server Owner" refers to any User who registers a Hytale server on our platform.

"Voter" refers to any User who casts votes for servers listed on our platform.

"Content" refers to any text, images, graphics, logos, server information, or other materials submitted, posted, or displayed on the Service.

"Server Listing" refers to a registered server entry on the platform, including its name, description, IP address, and associated metadata.

"Sponsored Slot" refers to a premium advertising placement on the platform that provides enhanced visibility for a Server Listing, obtained through our auction system.

"Auction" refers to the competitive bidding process through which Sponsored Slots are allocated to Users.

3. Eligibility

3.1 You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms.

3.2 By using the Service, you represent and warrant that you meet the eligibility requirements and have the legal capacity to enter into these Terms.

3.3 We reserve the right to request proof of age or parental consent at any time and to suspend or terminate accounts that do not meet these requirements.

4. Account Registration

4.1 Certain features of the Service may require you to create an account. When registering, you agree to provide accurate, current, and complete information.

4.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.3 You must notify us immediately of any unauthorised access to or use of your account.

4.4 We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk.

4.5 You may not transfer or assign your account to any third party without our prior written consent.

5. Server Listing Guidelines

5.1 Accuracy of Information: Server Owners must ensure that all information provided in their Server Listing is accurate and up to date, including server name, IP address, description, and any other details.

5.2 Ownership and Authorisation: You must be the owner or an authorised representative of any server you list. Listing servers without proper authorisation is prohibited.

5.3 Prohibited Content: Server Listings must not contain or promote:

• Illegal activities or content
• Malware, hacking tools, or security exploits
• Hate speech, discrimination, or harassment
• Sexually explicit or pornographic content
• Content that infringes on intellectual property rights
• Misleading or fraudulent information
• Content harmful to minors

5.4 Server Conduct: Servers listed on our platform should maintain reasonable standards of conduct. We reserve the right to remove listings for servers that engage in widespread abuse, fraud, or other harmful activities.

5.5 Compliance with Game Terms: Server Owners are responsible for ensuring their servers comply with Hytale's official terms of service and any applicable community guidelines.

6. Voting System

6.1 Our voting system allows Users to vote for their favourite servers to help determine rankings and visibility on the platform.

6.2 Fair Voting: Users agree to vote fairly and honestly based on their genuine experience with servers.

6.3 Prohibited Voting Practices: The following are strictly prohibited:

• Using automated tools, bots, or scripts to cast votes
• Creating multiple accounts to cast additional votes
• Vote manipulation, including buying or selling votes
• Coercing or incentivising Users to vote in deceptive ways
• Exploiting technical vulnerabilities in the voting system

6.4 Vote Rewards: Server Owners may offer in-game rewards for voting through legitimate Votifier or similar systems. Such rewards must be delivered as promised and must not violate any game terms of service.

6.5 Enforcement: We reserve the right to invalidate votes, reset vote counts, or remove Server Listings that engage in vote manipulation.

7. Sponsored Slots and Auction System

7.1 Overview: We offer Sponsored Slots that provide premium placement and enhanced visibility for Server Listings on our platform. Sponsored Slots are allocated through a competitive auction system.

7.2 Auction Participation: By participating in any Auction, you agree to be bound by the auction rules and these Terms. You must have a registered account in good standing to participate in Auctions. We reserve the right to restrict Auction participation to Users who meet certain eligibility criteria.

7.3 Binding Bids: All bids placed in an Auction are binding and constitute a legally enforceable offer to purchase the Sponsored Slot at the bid price. By placing a bid, you represent and warrant that you have the authority and financial means to complete the transaction if you are the winning bidder.

7.4 Winning an Auction: The winning bidder is determined according to the auction format and rules specified for each Auction. Upon being declared the winning bidder, you enter into a binding agreement to purchase the Sponsored Slot at the winning bid price.

7.5 Payment Terms: If you win an Auction, you agree to submit full payment within forty-eight (48) hours of being notified of your winning bid. Payment must be made using one of the accepted payment methods specified on the platform. All payments are processed in the currency specified at the time of the Auction.

7.6 Failure to Pay: If you fail to complete payment within the forty-eight (48) hour payment window, the following consequences will apply:

(a) Your winning bid will be forfeited and the Sponsored Slot may be offered to the next highest bidder or re-auctioned at our sole discretion;

(b) Your account may be suspended or terminated;

(c) You may be permanently banned from participating in future Auctions, at our sole discretion;

(d) We reserve the right to pursue any outstanding amounts owed and any additional damages or costs incurred as a result of your failure to pay.

7.7 Auction Bans: We reserve the right to ban Users from participating in future Auctions for any violation of these Terms, including but not limited to: failure to pay for a won Auction; engaging in bid manipulation, shill bidding, or collusion; creating multiple accounts to circumvent auction rules; or any other conduct that undermines the integrity of the auction system. Auction bans may be temporary or permanent at our sole discretion and may be applied without prior notice.

7.8 Sponsored Slot Terms: Each Sponsored Slot is subject to the specific terms, duration, and placement details specified at the time of the Auction. Sponsored Slots are non-transferable unless expressly permitted by us in writing. We reserve the right to remove or reposition Sponsored Slots if the associated Server Listing violates these Terms or our content guidelines.

7.9 Refunds: Payments for Sponsored Slots are generally non-refundable. Refunds may be issued at our sole discretion in exceptional circumstances, such as if we are unable to deliver the Sponsored Slot as described. Partial refunds may be considered if a Sponsored Slot is removed due to a violation of these Terms by us.

7.10 Auction Modifications: We reserve the right to modify, suspend, or cancel any Auction at any time and for any reason, including but not limited to technical issues, suspected fraud, or insufficient participation. In the event of an Auction cancellation, any bids placed will be voided and no payment will be due.

7.11 Taxes: You are responsible for any taxes, duties, or other governmental charges applicable to your purchase of a Sponsored Slot. Prices displayed may or may not include VAT or other applicable taxes, as specified at the time of the Auction.

8. Intellectual Property

8.1 Our Rights: The Service, including its design, features, functionality, and all associated intellectual property rights, is owned by Lucid ICT Limited or its licensors. You may not copy, modify, distribute, or create derivative works based on our Service without express written permission.

8.2 Your Content: You retain ownership of any Content you submit to the Service. By submitting Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute such Content in connection with operating and promoting the Service.

8.3 Third-Party Rights: "Hytale" is a trademark of Hypixel Studios. Hyvote is an independent platform and is not affiliated with, endorsed by, or sponsored by Hypixel Studios or any of its affiliates.

8.4 Copyright Complaints: If you believe that Content on our Service infringes your copyright, please contact us with the following information:

• A description of the copyrighted work
• The location of the allegedly infringing material on our Service
• Your contact information
• A statement of good faith belief that the use is not authorised
• A statement, under penalty of perjury, that the information is accurate and you are authorised to act on behalf of the copyright owner

9. User Conduct

9.1 You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit harmful code, including viruses or malware
• Attempt to gain unauthorised access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers connected to it
• Engage in any activity that could damage, disable, or impair the Service
• Harvest or collect user information without consent
• Impersonate any person or entity
• Engage in spam, phishing, or other deceptive practices

9.2 We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing Content, suspending or terminating accounts, and reporting to law enforcement authorities.

10. Privacy and Data Protection

10.1 Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10.2 By using the Service, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

10.3 We comply with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

11. Third-Party Links and Services

11.1 The Service may contain links to third-party websites, services, or content that are not owned or controlled by us.

11.2 We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

11.3 You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with use of any third-party websites or services.

11.4 Server Listings direct Users to third-party game servers. We do not operate these servers and are not responsible for their content, conduct, or availability.

12. Disclaimers

12.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected

12.3 We do not endorse, guarantee, or assume responsibility for any server listed on our platform, any content posted by Users, or any third-party products or services advertised or offered through the Service.

12.4 You acknowledge that servers listed on our platform are operated by independent third parties and that we have no control over their operation, content, or conduct.

13. Limitation of Liability

13.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUCID ICT LIMITED AND ITS DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

13.2 IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED POUNDS (£100), WHICHEVER IS GREATER.

13.3 Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be excluded or limited under applicable law

14. Indemnification

14.1 You agree to indemnify, defend, and hold harmless Lucid ICT Limited and its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any Content you submit to the Service
• Your participation in Auctions and any failure to complete payment obligations

15. Modifications to the Service and Terms

15.1 We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

15.2 We may revise these Terms from time to time. The most current version will always be posted on this page with the "Last Updated" date.

15.3 Material changes to these Terms will be communicated through the Service or by other means we deem appropriate.

15.4 Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

16. Termination

16.1 We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

16.2 You may terminate your account at any time by contacting us or using the account deletion feature if available.

16.3 Upon termination:

• Your right to use the Service will cease immediately
• We may delete your account and any associated Content
• Any outstanding payment obligations for won Auctions remain due and payable
• Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability

17. Governing Law and Dispute Resolution

17.1 These Terms shall be governed by and construed in accordance with the laws of Scotland and the United Kingdom, without regard to conflict of law principles.

17.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Scotland.

17.3 If you are a consumer, you may also be entitled to use the European Commission's Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr.

18. General Provisions

18.1 Entire Agreement: These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Lucid ICT Limited regarding your use of the Service.

18.2 Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18.3 Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

18.4 Assignment: We may assign or transfer these Terms, in whole or in part, without restriction. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent.

18.5 Notices: Any notices or communications from us will be provided via the Service, email, or other means we deem appropriate.

18.6 Force Majeure: We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or government actions.
